Caledon trucking company fined $ 1m by court
the Ontario Superior Court of Justice (Toronto region) fined a Caledon truck driver $ 1 million.
On December 9, the court fined Darzi Holdings Ltd. $ 1 million. after finding the company in contempt of court on Feb.8, according to a statement from the town of Caledon.
“This is a huge victory and signals to those who break our bylaws that the City takes enforcement seriously,” Mayor Allan Thompson said in a statement.
The city said that in 2018, there were complaints of debris, mud tracking, importation of landfill, grading without a permit, improper parking and storage of utility vehicles, and under- equipment contracting at a property on Coleraine Drive in Bolton.
The city said the owner pleaded guilty in 2019 and was fined $ 36,000 after being charged with violating the city’s zoning by-law.
According to the city, when the owner failed to bring the property into compliance with the bylaw, the city sought a civil injunction. The city said in the statement that when the uses continued despite court orders to comply with city bylaws, the city requested a verdict of contempt.
Considering the owner in contempt, the court ruling said, “In my opinion, a fine of $ 1 million requested by the City will serve some of the purposes of denunciation and general deterrence. The City is asking for a fine of $ 1 million. Despite my reservations as to the sufficiency of this amount, I assess a fine of $ 1 million payable by the defendants jointly and severally. “
